Terms of sale

Seller

These general terms and conditions of sale (GTC) apply to sales concluded on the 101% Garce website (101pourcentgarce.com), operated by Chrispal Group, Rue du Moléson 18, 1636 Broc, Switzerland.

E-mail: info@101pourcentgarce.com. Hereinafter "the Seller". The person placing the order is hereinafter "the Customer".

Article 1 — Purpose

The GTC define the rights and obligations of the Seller and the Customer for the distance selling of the products offered on the website: message T-shirts and apparel. They are brought to the Customer's attention before the order is confirmed; the applicable GTC are those in force on the date of the order.

Article 2 — Products and variants

The essential characteristics of each product are set out on its product page: description, material, cut, available sizes and colors. The Customer chooses their size and color using this information and may ask the Seller if in doubt. Colors may vary slightly depending on the screen used. Products are offered while stocks last.

Article 3 — Prices

Prices are shown in the currency displayed on the website, including all applicable taxes, excluding shipping costs. Shipping costs are shown before the order is confirmed and are added to the price of the products, except when shipping is free (see article 7). The price charged is the one displayed at the time of the order.

Article 4 — Orders

The Customer selects their products and variants, enters their contact details and shipping address, chooses a shipping method, checks the order summary and total price, then confirms the order by paying. An order confirmation is sent by e-mail. The contract is concluded when the payment is confirmed.

Article 5 — Payment

The price is payable in full at the time of ordering, using one of the payment methods offered at checkout. Payment is processed by a secure payment provider; the Seller has no access to the Customer's bank details and does not store them.

Article 6 — Retention of title

The products remain the property of the Seller until the price has been paid in full.

Article 7 — Shipping

7.1 Area. Products are delivered in France, in the European Union and in the countries offered at checkout, to the address provided by the Customer when ordering.

7.2 Costs. France: standard shipping €7.99, free on orders of €65 or more, or express €10.99. European Union: €22. Other countries: €29. The applicable amount, converted into the order currency, is displayed before the order is confirmed. Outside the European Union, import duties and taxes may be charged on delivery by the authorities of the destination country.

7.3 Lead time. The delivery time is shown at checkout. In any event, the Seller delivers the products without undue delay and no later than thirty days after the conclusion of the contract (article L216-1 of the French Consumer Code). A tracking number is sent by e-mail when the order ships.

7.4 Delay. If the Seller fails to deliver within this period, the Customer may, after requiring the Seller to deliver within a reasonable additional period, terminate the contract if delivery does not take place within that period (article L216-6 of the French Consumer Code). The sums paid are then refunded within fourteen days.

7.5 Transfer of risk. The risk of loss of or damage to the products passes to the Customer when they take physical possession of them (article L216-4 of the French Consumer Code).

Article 8 — Right of withdrawal

A Customer who is a consumer has fourteen days from receipt of the products to exercise their right of withdrawal, without having to give any reason (article L221-18 of the French Consumer Code).

The Customer notifies the Seller of their decision by an unambiguous statement, for example by e-mail to info@101pourcentgarce.com. They then return the products without delay and no later than fourteen days after this notification; return costs are borne by the Customer. Products must be returned in their original condition, unworn, unwashed, with their tags and packaging; the Customer may be held liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the products (article L221-23).

The Seller refunds all sums paid, including the initial shipping costs (up to the standard shipping rate), no later than fourteen days after being informed of the Customer's decision. The Seller may withhold the refund until the products have been received or until proof of their shipment has been provided. The refund is made using the payment method used for the order (article L221-24).

Article 9 — Legal warranties

Products are covered by the legal warranty of conformity (articles L217-3 et seq. of the French Consumer Code), which applies for two years from delivery of the goods, and by the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code), which applies for two years from discovery of the defect. These warranties apply independently of any commercial warranty.

To invoke them, the Customer contacts the Seller using the contact details given at the top of these terms, stating their order number and the defect observed.

Article 10 — Customer service

For any question or complaint: e-mail info@101pourcentgarce.com, post Chrispal Group, Rue du Moléson 18, 1636 Broc, Switzerland.

Article 11 — Personal data

Data collected when ordering is processed in accordance with the website's privacy policy, which the Customer is invited to consult.

Article 12 — Intellectual property

The elements of the 101% Garce website (texts, visuals, logo) are protected. Their reproduction without the written authorization of Chrispal Group is prohibited.

Article 13 — Force majeure

Performance of the Seller's obligations is suspended in the event of force majeure within the meaning of article 1218 of the French Civil Code. The Customer is informed as soon as possible.

Article 14 — Governing law and disputes

These GTC are governed by French law. In the event of a dispute, the Customer is invited to contact customer service first to seek an amicable solution. Failing that, a Customer who is a consumer may bring the matter, at their choice, before the court of the place where they resided at the time the contract was concluded or the harmful event occurred, or before any other competent court.
